Terms of Service

1. Eligibility

You must be at least 14 years of age to create an account or use the Service. By using the Service, you represent and warrant that you meet this age requirement. If you are under 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.

2. The Service

APP_NAME provides end-to-end encrypted communication including text messaging, voice, and video. We do not have access to the content of your encrypted messages. We reserve the right to modify, suspend, or discontinue the Service (or any part of it) at any time, with or without notice.

3. Your Account

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must not share your login credentials with third parties. You agree to notify us immediately at [email protected] if you suspect unauthorized access to your account.

4. Acceptable Use

You agree not to use the Service to:

• Distribute malware, viruses, or any harmful code
• Harass, threaten, defame, or intimidate any person
• Distribute illegal content, including child sexual abuse material
• Infringe upon the intellectual property rights of others
• Attempt to compromise the security of the Service or other users
• Impersonate any person or entity, or misrepresent your affiliation
• Use the Service for unauthorized commercial purposes or spam
• Engage in any activity that violates applicable local, state, national, or international law

5. Intellectual Property

The Service, including its design, code, branding, and documentation, is owned by FROSTCRYPT LLC and protected by applicable intellectual property laws. You retain ownership of content you create and transmit through the Service. By using the Service, you grant us a limited, non-exclusive license to process your content solely as necessary to operate the Service.

6. Copyright & DMCA

We respect the intellectual property rights of others. If you believe content on the Service infringes your copyright, you may submit a DMCA takedown notice to [email protected] with: (a) identification of the copyrighted work, (b) identification of the infringing material, (c) your contact information, (d) a statement of good faith belief, and (e) a statement under penalty of perjury that the information is accurate.

7. Termination

We may suspend or terminate your account at our sole discretion if we reasonably believe you have violated these Terms. You may delete your account at any time through your account settings. Upon termination, your right to use the Service ceases immediately. Sections 5, 8, 9, 10, and 11 survive termination.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FROSTCRYPT LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUE, WHETHER INCURRED DIRECTLY OR INDIRECTLY, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR $100 USD, WHICHEVER IS GREATER.

10. Indemnification

You agree to indemnify, defend, and hold harmless FROSTCRYPT LLC and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from your use of the Service or your violation of these Terms.

11. Governing Law & Disputes

These Terms are governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any disputes arising from these Terms or the Service shall be resolved exclusively in the state or federal courts located in Delaware. You waive any objection to jurisdiction and venue in such courts.

12. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will notify you through the Service or by email at least 30 days before the changes take effect. Continued use of the Service after the effective date of revised Terms constitutes your acceptance of the changes. If you do not agree to the revised Terms, you must stop using the Service.

13. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

14. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and FROSTCRYPT LLC regarding the Service and supersede all prior agreements.
